Hayes + Associates

Injury Biomechanics. Clearly Explained.

The Injuries Tell the Story. Reconstructions Tell Us Why.

Litigated injury cases begin with the injuries. At Hayes+Associates we believe that the injuries themselves tell us what happened, but only if the injuries are described in the context of a scientifically reliable accident or incident reconstruction.

At H+A we do both injuries and reconstructions. Seamlessly.

Academic Experience. Foundational Research.
Litigation Success

Hayes+Associates was formed while its founder, Wilson C. “Toby” Hayes, Ph.D., was teaching Human Functional Anatomy at Harvard Medical School. Dr. Hayes manages the firm and leads our Injury Biomechanics practice, testifying, often based on his own published research, as an expert in mechanical engineering, biomechanics, and human functional anatomy.

Erik D. Power, P.E., joined H+A in 2003, with engineering degrees from Virginia Tech and work experience at the National Highway Traffic Safety Administration (NHTSA). Mr. Power leads our Accident Reconstruction team, testifying as an expert in mechanical engineering and biomechanics.

PRACTICE AREAS

All anatomic regions.
All injury severities.
All causes.

Hayes + Associates is retained in matters across the broadest range of anatomic regions, including those to the head, neck and low back, injury severities, including those from minor to fatal, and precipitating causes, including:

Vehicle Collisions · Premises Safety · Falls · Products Liability · Worker Safety · Sports & Recreation · Criminal Matters

The firm is retained, nearly equally, by both plaintiffs and defendants in civil and criminal matters, and State and Federal Courts, bringing the same science=based, integrated analysis methods to minor, disputed injury incidents such as fender benders that we do to catastrophic, multiple injury cases involving rollovers, multiple vehicles, heavy trucks, and transportation incidents.

SERVICES

Cutting-edge tools.
Expected outcomes.

Hayes+Associates brings together injury biomechanics and accident and incident reconstructions to render opinions on the biomechanical causation of injuries. In support of these determinations, H+A uses state-of-the-art tools for both Injury Severity Assessments and for engineering reconstructions of motor vehicle accidents and other incidents.

Formal injury severity assessments are based on the Abbreviated Injury Scale (AIS), a scaling tool that is used in trauma centers worldwide. AIS scores are used to predict whole-body trauma burden and probability of survival. The Analyses are illustrated by annotated versions of the radiology. Accident and incident reconstructions are based on industry standards and make use of cutting-edge equipment and data collection tools. Our available services include downloading Event Data Recorder (EDR) information from vehicles, aerial photography using a drone, and detailed measurements using a FARO 3D laser scanner.

Client Support from Retention through Resolution

Hayes + Associates believes that our retention begins a collaborative process with our clients. We return your calls and meet your deadlines. If requested, we provide preliminary desktop injury severity assessments and first-order incident reconstructions to let you know, within the bounds of our retainer, our early impressions.

We support disclosure, mediations, motion practice, conduct site inspections, keep you in the loop with the progress of our work, and prepare together with you for deposition and trial. We provide records summaries, anatomic illustrations, surveillance video analysis, and exhibits for trial.
